Disturbing, this is the most appropriate word. It feels like the 80s again. When the hackers were the big bad people in politician’s, media’s, general public’s… and police officers’ heads. A swedish hackerspace was raided last week, for no apparent valid reason (illegal bar investigation in a punk concert next door, and they came with IT experts and seized computers..). Is swedish administration so retarded that it didn’t evolve and understand the importance of coders and open source gurus that are constituting hacker spaces everywhere in the world? We’re at least expecting some explanation from sweden but it doesn’t seem to be coming… (more details and french version available below)

At 20.45 on Saturday the 28th of November the police raided the social
centre Utkanten in  Malmö, where the hackerspace Forskningsavdelningen
is housed. Twenty officers in full  riot gear and ski masks broke into
the space through the entrance and a backdoor, using crowbars. Shortly
thereafter  twenty  to  thirty  more  showed  up,  mostly  dressed  as
civilians and some of  them IT technicians from Länskriminalen (county
police), who are  suspected to be interested in  the hackerspace. They
stayed in the building for about six hours.

The official  reason for the raid was  to do a “pub  check” because of
the suspicion that there was  illegal selling of alcohol going on. The
allegedly  illegal club  activity was  a punk  concert, with  about 40
guests at the time of the  raid. After the raid the cops evacuated the
building,  searched through  it and  confiscated a  lot of  stuff. The
police was indiscriminate  as to whose effects were  removed, taking a
lot  of  equipment  from  Forskningsavdelningen and  peoples  personal
computers, even though the hackerspace was unaffiliated with the group
arranging the concert downstairs.

At  the   time  of   the  raid  there   were  about  five   people  at
Forskningsavdelningen. All of us were searched and photographed. Those
who  criticized the  harrasment were  threatened  to be  taken to  the
station for “drug tests”. Overall the police seemed hostile.

What did they take? We have gone  through our stuff and made a list of
what is definitely missing, but since  the cops havent given us a list
of what they’ve taken we might have missed some stuff.

* 2 office computers, refurbished

* 1 gaming computer, 6500 SEK

* 1 digital camera, Canon Powershot

* 1 external 2.5″ hard drive

* 2 key cutters

* lock-picking practice locks (cut-away)

* 1 wlan dishes antenna

* 1 pocket calculator (casio)

* 5 bottles of rum (Bacardi)

* blank keys, to a value of 200 SEK (not more?)

* material for building metal lockpicks

* metal files

* 1 backpack

We need your support! We all  feel really offended by this and some of
the confiscated equipment is going to  be hard to replace. If you want
to help us there are some things you can do:

* Publish an open letter of support and send us the link

* We’re gonna need  to replace some equipment. If  you have any of
the following  stuff and want to  donate it, please  bring it on
tuesday or send us a mail.
– any “modern” pc to use as an office computer, we’re gonna need
a couple  of them  (we still have  two or three  monitors and,
plz, no CRT’s
– some kind of wifi router

* Do  fun  stuff   with  us,  we’re  gonna  meet   on  tuesday  as
always. Come and help us make  the place even better than it was
before the raid and bring fun stuff to play with

* It is  common in Sweden  that the police never  return computers
once  they have  been  raided. If  they  give it  back, it  will
usually at least  take some years, the computers  will be old by
then. If you want to  support us finacially you can donate money
to a swedish account or a  paypal one. All donated money will go
to replacing the lost personal and collective hardware.

Lettre ouverte pour le soutien à Forskningsavdelningen

Le 28 Novembre, à Malmö, la police a procédé à un raid dans un club de nuit supposé illégal. La raison officielle de cette opération était la suspicion que ce club, qui organisait un concert punk ce soir-là, de vendre de l’alcool sans avoir la licence. Et la police y a en effet trouvé et confisqué de la bière, du vin, et d’autres alcools, ainsi que quelques effets personnels dont la présence n’était pas très surprenante dans le cadre d’un concert punk (feu d’artifice, bombes lacrymo, etc.). Vous trouverez plus de détails dans le communiqué de presse officiel de la police.

Jusque-là, rien d’excitant.

Ce que le communiqué de presse oublie de mentionner, c’est que la police a aussi, pendant ce raid, visitait une autre organisation qui n’a rien a voir avec le club de nuit, mais qui est simplement située dans le même bâtiment: le hackerspace Forskningsavdelningen.

Forskningsavdelningen est un hackerspace: un endroit où les personnes intéressées par les technologies partagent leur savoir et travaillent ensemble. Quels liens cette organisation, hébergée à un étage différent, avaient avec une fête, organisée par une entité différente, suspectée d’être illégale ? Pas grand chose apparemment.

Admettons que leur raid n’était dû qu’à la malchance, suite à de mauvais renseignements côté policier. Embêtant, mais pas critique.

Hors la police a aussi confisqué au Forskningsavdelningen six ordinateurs, un routeur wifi, et d’autres équipements techniques d’une certaine valeur, et envisage l’ouverture d’une enquête pour “cambriolage aggravé” et “intrusion informatique”.

La base de la plainte pour “cambriolage aggravé” repose sur le fait que la police a trouvé, parmi l’équipement de ce hackerspace, 2 machines à copier des clés et un ensemble d’outils de crochetage de serrures. D’après la police, cela indique qu’un cambriolage était en cours de préparation. De la même façon, la présence d’une “antenne spéciale pour capter du signal radio à grande distance” est utilisée pour justifier la suspicion d’intrusion informatique.

La possession et l’utilisation de ces outils reste parfaitement légale – à moins bien sûr qu’ils ne soient utilisés de manière illégale. Un couteau peut être utilisé pour couper un steak ou pour poignarder quelqu’un. Si je possède un couteau, cela me donne-t-il de mauvvaises intentions ?

Posséder une antenne – même si elle est “spéciale”, ou modifiée – n’indique pas mon intention de commettre un crime. Cela met juste en avant mon intérêt pour les transmissions sans-fil, et pourrait être en fait le premier prototype d’une technologie nouvelle.

Concernant le crochetage de serrure ? Même chose. Le crochetage de serrure (ou ‘lock picking’) est un sport pratiqué par des clubs officiels partout en Europe. En plus de permettre à leurs membres de se rassembler, ces clubs informent le public en faisant la démonstration des failles de sécurité des serrures courantes. La préparation à ce sport n’est pas plus une préparation au cambriolage que le sport de tir n’est une prémeditation de meutre.

Nous sommes profondément inquiets par la disparition d’un droit légal le plus basique – la présomption d’innocence. Nous ne pouvons accepter qu’une étude ouverte et critique de la technologie soit utilisée comme preuve pour accuser des personnes innocentes.

En temps que membres du Metalab, un hackerspace à Vienne, en Autriche, nous exprimons notre solidarité avec nos amis Suédois. Nous nous joignons à eux pour demander le retour de tout leur équipement saisi, et nous espérons sincèrement que toute cette affaire ne soit qu’un malentendu plutôt qu’une manipulation intentionnelle des droits d’innocents citoyens.

Afin de restaurer le principe de sécurité juridique et d’éviter la répétition d’erreurs similaires dans le futur, nous recommandons fortement une investigation complète sur ce raid (ses raisons et son exécution proprement dite) ainsi que les bases légales (ou l’absence de ces bases) sur l’ouverture d’investigation concernant la possession d’équipements légaux.
